1. What we do
Daymaker is a service operated by Jubelbud AS that bakes a custom cake (with your message, deck, logo, or other design printed in edible icing) and hand-delivers it to a recipient at an address you select. Service is currently limited to San Francisco and the broader Bay Area unless explicitly stated otherwise.
2. Pricing
Cakes start at USD $99. Larger cakes, custom packaging, rush delivery, and certain extras cost more. The price you see at checkout is the price you pay. We do not add fees after the fact.
3. How an order works
- You pick a recipient from our directory or supply your own.
- You upload or specify what goes on the cake.
- You pay.
- We bake.
- We hand-deliver.
- When possible, our delivery person sends back a photo of the drop. We try to do this on every order, but we do not promise it. The delivery person sometimes forgets. The lobby is sometimes off-limits to photos. The phone sometimes dies. We do not owe you a photo, and missing photo proof is not grounds for a refund or claim.
An order is considered complete the moment the cake leaves our hands at the delivery address, regardless of whether a photo was taken.
4. Limits
To prevent saturation and protect the channel, each individual recipient is limited to two cakes per calendar month. We may decline orders that would exceed this limit.
5. The three non-guarantees, in long form
5.1 Address accuracy
Our recipient directory is built from public sources. We update it regularly but we cannot warrant that any given address is current at the moment of delivery. If you supply your own address, you are solely responsible for its accuracy.
5.2 Recipient acceptance
The recipient is under no obligation to accept the cake. Receptionists routinely refuse unsolicited deliveries. Some firms have no-gift policies for compliance reasons. Some buildings prohibit non-employee deliveries. We attempt the delivery in good faith and document the outcome. We do not litigate refusals.
5.3 No refunds
All cakes are custom goods made to your specifications. Under Norwegian and EU consumer law (Angrerettloven § 22 / Consumer Rights Directive Art. 16(c)), the standard 14-day right of withdrawal does not apply to goods made or clearly personalised to the consumer's specification. Daymaker invokes this exemption.
This means: once you have placed an order, you have no right to a refund. Not for change of mind. Not for a refused delivery. Not for an unanswered reply. Not for any reason.
6. Your responsibilities
- You are responsible for the message and any third-party content you choose to put on the cake.
- You will not use the service to send threats, harassment, defamation, sexually explicit content, or anything that is unlawful.
- You will not impersonate another person or company.
- If you supply a recipient address yourself, you confirm you have the right to send them a physical good.
We may refuse or cancel an order at our sole discretion if we believe it violates this section. If we cancel for this reason and we have not yet started baking, we will refund. Once baking has started, see Section 5.3.
7. Brand names and logos
You are responsible for any third-party trademarks, logos, or images you ask us to put on a cake. By placing the order you confirm you have permission to use them, or that the use is fair use, parody, news reporting, or otherwise legally permitted. We may decline to print content we believe creates legal risk.
8. Allergens
Cakes contain wheat, eggs, dairy, and may contain traces of nuts and soy. Gluten-free options are available on request. We are not responsible for adverse reactions experienced by recipients. The recipient is welcome to not eat the cake.
9. Intellectual property
The Coldcaked name, the Daymaker name, this site, the maps, the directory, and all related materials are the property of Jubelbud AS. You receive no licence to use them beyond placing orders.
10. Limitation of liability
To the fullest extent permitted by law, Jubelbud AS is not liable for indirect, incidental, consequential, or punitive damages arising from the service. Our total liability for any claim arising from a single order is limited to the price you paid for that order. Mandatory consumer rights under Norwegian and EU law are unaffected.
11. Governing law and disputes
These terms are governed by the laws of Norway. Any dispute that cannot be resolved informally will be brought before Oslo tingrett (Oslo District Court), with one exception: if you are a consumer resident in another EU/EEA country, you may also bring an action in the courts of your country of residence, as required by Council Regulation (EU) No 1215/2012 (Brussels Ia).
You may also file a complaint with the Norwegian Consumer Council (Forbrukerrådet) or use the EU's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Changes
We may change these terms. The "last updated" date at the top of this page reflects the current version. Continued use of the service after a change means you accept the updated terms.
